Google to continue offering Exchange support on Windows Phones through July 31st

Today is the day that Google has been planning to shut off its support for Exchange ActiveSync, but it appears that the company has had a slight change of heart. Google has confirmed that it will allow Windows Phones to access Google Sync services for an additional six months, ending on July 31. This move will allow Microsoft a little extra breathing room, giving the company more time to determine how to best resolve the concern that will affect countless Gmail fans that currently use Windows Phone as their primary driver; let's hope this means the platform will be updated to offer CalDAV support before time runs out.

We reached out to Google and received this confirmation: "As announced last year, our plan is to end support for new device connections using Google Sync starting January 30, 2013. With the launch of CardDAV, it's now possible to build a seamless sync experience using open protocols (IMAP, CalDAV and CardDAV) for Gmail, Google Calendar and Contacts. We'll start rolling out this change as planned across all platforms but will continue to support Google Sync for Windows Phone until July 31, 2013."

Sony's Music Unlimited sounds even better with high fidelity streaming

Sony has a treat in store for Music Unlimited subscribing audiophiles: you can now stream music in high quality 320kpbs AAC audio.

Using the service's web, Android, Walkman and PS3 apps, Sony says you can now enable "pristine" high fidelity playback. The entire catalogue offers the 320kpbs AAC option provided by Omnifone, the company that powers Sony's music library.

If you don't want to be stuck with tedious average audio, you'll have to turn the 320kbps streaming option on in Music Unlimited's settings menu.

Before today's boost, Music Unlimited used only the HE-AAC v2 codec at 48kbps. So if you aren't running the Android, web or PS3 apps, you'll still be stuck with 48kbps which is crappy at best, but Sony promises a boost to this 'normal' level is coming later this year; it will be going up to 64kpbs HE-AAC v2.

It doesn't look as though the high quality option is available on Sony's smart Bravia TVs nor through its iOS app yet, although Sony promises it will be adding it to other devices "later".

Music Unlimited is Sony's in-house answer to Spotify - the illustrious multi-platform service already offers 320kpbs AAC playback but its quality consistency is questionable at best.

Android-powered Vertu Constellation Ti leaked all over, just needs a diamond-studded price tag (updated)

Shortly after the latest rumor that Vertu's prepping its first-ever Android-based device, eagle-eyed Blog of Mobile delivered further evidence to support the claim, and it even managed to dig out what it claims to be product shots of said phone. First of all, the name "Ti" and model number "RM-828V" are spotted across Bluetooth SIG, GLBenchmark and telecom regulator databases in Singapore and Macau. Having scanned through these pages we now know that the Ti will come with Android 4.0.4, an 800 x 480 display, a 1.5GHz processor, Bluetooth 4.0 and NFC. Blog of Mobile added that it's a Snapdragon MSM8260A SoC with WCDMA 850/900/1700/1900/2100 radio, accompanied by a rather lame 1,250mAh battery. Bluetooth SIG's page provided the following design description of the device:

"VERTU Ti possesses the classic Vertu design DNA and characteristics - strong, unique & distinctive. The design and craftsmanship positions VERTU Ti alongside other iconic products in the luxury market."

If the above images are authentic then the Ti does indeed maintain the classic Vertu look. The only real changes we can see so far are the three new physical keys -- presumably "Back," "Home" and "Recent apps" for Android. If all goes well, we should see this wallet-busting gadget at MWC next month, so start saving up now.

Update: Russian retailer spblux.ru lists four variants of the Ti or, as the site calls it, the Constellation Ti: "Titanium Black PVD black leather," "Titanium Black Alligator," "Red Gold Mixed Metal" and "Titanium Black Leather." Interestingly, the red gold version has a search button instead of "Recent apps," but we guess that was an earlier design. Kenya elections observers to enhance transparency

NAIROBI, Kenya (AP) ? Kenya's first nation-wide vote since devastating violence broke out after the nation's 2007 presidential election will be closely monitored by the international community and local observers to help ward off potential problems, officials said Monday.

The disputed 2007 presidential election sparked off ethnic fighting that killed more than 1,000 people, and observers warn there is an unacceptably high risk of repeat violence around Kenya's March 4 vote. A chaotic primary vote this month and outbreaks of deadly violence around the country have done little to instill confidence that peace will prevail.

Kenya's election commission says at least 1,014 international observers and more than 10,000 local observers have been accredited. The United States said it will field a team of about 105 observers.

"We hope our ongoing engagement on electoral preparations combined with the presence of election observers from the U.S. government, international partners, and Kenyan groups before and during the election will help ensure that the electoral process is free, fair and peaceful, thereby giving the Kenyan people confidence in the legitimacy of election results," U.S. Embassy spokesman Christopher Snipes said.

The U.S. is encouraging Kenyans to put aside tribal and ethnic differences, reject intimidation and violence, demand an end to impunity and to address any electoral disputes through Kenya's courts, rather than on the streets, Snipes said.

The European Union observer team will be smaller in number than in 2007 ? 70, down from 132 ? but will spend more time in the country analyzing the buildup to the vote, said Gillian McCormack, deputy head of the EU observer mission.

Kenya has introduced political reforms to address the flawed 2007 polls. A new constitution passed in August 2010 has put checks and balances on government bodies. The constitution also established a robust Supreme Court and initiated judicial reforms that have resulted in more than a dozen higher court judges being fired over lack of integrity.

A report this month by the Council on Foreign Relations listed several reasons to fear violence might reoccur: the country's top presidential candidates are mobilizing voters along ethnic lines; the vote is likely to be very close; the election commission will be unable to fully prepare for the election; and one presidential candidate faces trial at the International Criminal Court for violence perpetrated after the 2007 vote.

"The United States and others may have limited leverage over Kenya's domestic politics, but they are not without options that would significantly improve the prospects for acceptable elections and help avert a major crisis," the report said. "However, with little more than two months before the elections, Washington must intensify its engagement or forsake its opportunity to make a difference."

The U.S. is financially supporting observers from the Carter Center ? run by former President Jimmy Carter ? and the largest Kenyan group of observers, said Snipes.

The International Crisis Group said in a recent report that high youth unemployment and inequality encourage the growth of criminal groups and militias who want to intimidate political opponents.

A couple of PR-related studies released earlier this month underscore two major challenges that PR pros now face, one that is tactical in nature and the other that is in a more strategic vein.

The first study is another reminder that, in a digital age, every company is a media company and PR pros must now add ?quasi network programming executive? to their job description.

The study, which was conducted by PR agency Weber Shandwick, found that the percentage of CEOs using online video to promote their company narratives grew to 40% in 2012, compared with just 18% in 2010.

Growth in video is nearly evenly divided between CEOs appearing in videos on company websites and on corporate YouTube channels, according to the study, which is based on publicly visible activities of CEOs in the world?s largest 50 companies

Indeed, as a growing number of ?CEOs get ready for their close-up the onus is on?communications execs to create and/or produce the kind of online-video programming that will put their boss in the best possible light.

Does the CEO manage by walking the floor? Produce an online-video that shows how he or she interacts with employees and focus on the sense of camaraderie that the CEO strives on. Maybe your CEO tells great anecdotes about your company?s products and services? Pick a cozy, inviting setting for the CEO to tell a story, and splice the video with some B-roll of customer testimonials.

The creative in producing online videos is wide open (depending on how much budget you can commit). But that should be the easy part once you get buy-in from the CEO. The more salient ?question is whether PR pros can seize the momentum within online video while simultaneously building on their relationships with C-level execs.

The other study presents more nettlesome challenges for PR pros: how to make their companies more trustworthy and transparent. According to the 2013 Edelman Trust Barometer, which was released last week, business leaders are trusted by less than 50% in 16 of 26 markets, while government leaders are trusted by less than half in 21 of 26 markets.

The online survey sampled 26,000 general population respondents with an oversample of 5,800 informed publics ages 25-64 across 26 countries.

?We?re clearly experiencing a crisis in leadership,? said Richard Edelman, president-CEO, Edelman, in a statement. ?Business and governmental leaders must change their management approach and become more inclusive by seeking the input of employees, consumers, activists and experts such as academics, and adapting to their feedback. They must also pass the test of radical transparency.?

?Radical transparency? is something that PR pros need to aspire to; they?re in a position to develop and execute the communications strategy among all of the people (management, employees, customers and prospects) who have a stake in making sure their companies are more transparent and trustworthy.

PR pros can find many different routes to convince the public that they?re in the business of doing the right thing. Heck, one vehicle ?could be an online video featuring your CEO explaining what your company is doing to be more transparent. Talk about the perfect PR marriage of the tactical and the strategic.

Iran arrests 11 reporters over 'foreign contacts'

TEHRAN, Iran (AP) ? Iran has arrested 11 journalists accused of cooperation with foreign-based, Persian-language media organizations, several chief editors of Iranian outlets said Monday.

The development is a major escalation in a press crackdown that reflects Iran's zero tolerance for those who work with dissident media or outlets deemed as unfriendly or hostile.

In recent years, Iran has denounced Voice of America and the BBC's Persian service, describing them as arms of U.S. and British intelligence agencies, and has warned of severe repercussions for Iranian journalists and activists caught having contacts with these outlets.

Also, Tehran has repeatedly accused the United States and Britain of seeking to provoke unrest in a bid to oust the country's clerical rulers, and has frequently accused opposition figures and supporters of being in league with the nation's enemies.

Many Iranians regularly tune in to the BBC and VOA's Persian-language radio and TV channels, despite a ban on satellite dishes and government attempts to jam the airwaves.

The chief editors of the arrested journalists told The Associated Press that the 11 were taken into custody late on Sunday because of their "foreign contacts." The editors, who spoke on condition of anonymity because of fears of reprisals, refused to say if the detained were accused of providing material specifically to BBC or VOA.

The arrests followed last week's warning by State Prosecutor Gholam Hossein Mohseni Ejehei who said journalists who are in contact with "hostile foreign media" would be punished. Ejehi described such reporters as "serving the enemy's purpose."

The detained journalists ? seven men and four women ? were identified by their editors. They are from six different news organizations, including four daily papers, a weekly and the semi-official ILNA news agency.

Some of them have in the past spent months behind bars over critical writings that were carried by foreign-based Iranian dissident media or writings that supported feminist activities.

One of the editors said three of the arrested were from the reformist daily Etemad. Three others were from the reformist Shargh daily, whose editor said they were arrested at the paper's building.

Another journalist, Saba Azarpeik from the Tejarat-e-Farda weekly, was also missing and feared arrested, according to a colleague, who also spoke on condition of anonymity for fear of reprisals.

Meanwhile, the semiofficial ISNA news agency said Monday that the conservative Tabnak news website, close to the former Revolutionary Guard commander Mohsen Rezaei, has been blocked. No reason was given.

Since 2000, Iran's judiciary has shut down more than 120 pro-reform newspapers and jailed dozens of editors and writers on vague charges of insulting authorities.

Cissy Houston talks devastating loss of Whitney

The loss of a child is devastating for a parent, and Whitney Houston's mother Cissy is no different. But while she remains in mourning for the loss of her talented daughter last January, Cissy is very tough-minded about the decisions Whitney made that sent her down the path toward her early death from accidental drowning, heart failure and cocaine use.

"Good mothers and good fathers and good families don't always have great children," she told TODAY's Savannah Guthrie Monday, in advance of the publication of her book "Remember Whitney: My Story of Love, Loss, and the Night the Music Stopped."?

"Bad people have good children. ... It's all their responsibility when they get to a certain age to choose their way," she continued. "She was taught, she knew the way."

'Remembering Whitney': The icon's mother pays tribute?

Houston clearly felt -- and still feels -- a lot of love for her late daughter ("she and I were very, very close. She knew I loved her") but in speaking with Guthrie, she didn't want to apportion blame.

"I don't know too much about Bobby Brown," she said when asked about Whitney's ex-husband. "I don't want to talk about him. ... I know he didn't help her. I don't blame him. ... Everybody is responsible for their own actions up to a point. She was raised, she knew better, and whatever took her to that position, I really don't know."

Still, in a later interview with TODAY's Al Roker, Houston went a bit further, saying marrying Brown "wasn't the greatest idea in the world" and that "he did hurt her in a lot of ways. ... She was in love, I guess."

Cissy said she did what she could to try and pull her daughter back from the brink, but suggested that the confusing world of the music business, being called "Whitey" early on and then the marriage match to Brown led to her daughter seeking self-medication.

"She was giving, loving. She -- just didn't like confusion; turned away from that as much as she could," Cissy told Roker, adding that "I really do" believe that's what led to her drug use.

In the end, whatever caused the death of Whitney Houston at age 48, the loss will never be fully repaired for her mother. "I miss her so much I can't even express it," she said, but added that she doesn't necessarily think that her daughter went before her time.

"I trust in God," said Houston. "His ways are not our ways so we have to go with that and there's nothing I can do about it."

France investigates Diane-35 acne drug after deaths

PARIS (Reuters) - France's health regulator has opened an inquiry into acne drug Diane-35, which is also used as a contraceptive, after four deaths linked to the drug in the past 25 years.

Health regulator ANSM said on Sunday that Diane-35, produced by German drugmaker Bayer, is authorized in 135 countries and sold in more than 116. Last year about 325,000 women in France used the drug, ANSM said, adding it would publish its report next week.

ANSM said the four deaths were due to thrombosis linked to the use of Diane-35. Three other deaths possibly connected to the drug, reported by the media, were linked to other health issues, the agency said.

Diane-35, also sold as Dianette in some countries, reduces acne for women by regulating hormones, according to several medical websites. The drug is also used as a contraceptive.

Earlier this month, ANSM said it was studying the possibility of limiting the use of third- and fourth-generation contraceptive pills after a woman sued Bayer over alleged side-effects such as embolism, or blood clots.

silimons success graphicFor King Solomon, who reigned for forty years, old age yields the rewards of a life well lived. ?Old age is a crown of dignity, which is found in the ways of justice,? he says in Proverbs 16:1. The King?s words suggest the importance of preparing early to enjoy those serene, comfortable years after retirement. Yet, according to a number of recent surveys, most Americans fail to plan realistically for retirement.

Many people responding to a recent survey on their retirement plans said they expected to work well beyond retirement age. Although the majority of these individuals were working in fields where retirement isn?t mandated ? as business owners, academics and professionals in law and medicine ? unforeseen circumstances can derail that plan. An unexpected health problem, changes in economic conditions, or even a change of heart about the whole thing can mean a need to fall back on retirement income.

Others, nearing retirement with limited savings, think it?s just too late to try to create a better income stream. These folks may be relying on an employer?s pension plan or Social Security to fill in the gaps. Some may have a retirement savings account without much in it. But financial experts say it?s never too late to start planning. And for those who can manage it, investing in real estate or becoming an entrepreneur may provide a solution to creating income in retirement.

A third group tends to rely on home equity as a backup source of retirement money. But, as the ups and downs of the housing market over the last few years have shown, that?s an income source that may not be reliable. If housing values fall, or sales go flat in the local market, homeowners needing to sell quickly may not end up with as much as they?d hoped on the deal.

There are other myths about retirement savings, too. People may simply miscalculate the amount needed for a comfortable and prosperous retirement. Anticipating needs, as well as the volatile nature of the economy, may be difficult. But in today?s world, people can expect to live a third of their lives ? or maybe more ? post-retirement. That?s a long time ? longer than many realize.

Of course, these myths about retirement are not really myths. There?s truth in them all. But as Solomon advises, wisdom and prudence can lay the foundation for a comfortable and prosperous life post retirement. The key is to take active steps to ensure a secure income stream. Investing in income property as a real estate entrepreneur, as Jason Hartman advises,? can lay the foundation for that kind of income stream, allowing retirees to enjoy life with that crown of dignity the King describes.

Analysis on Article 13 of the Colombian Ley Lleras 2.0 ? infojustice

andres[reposted from andresizquierdo.com] The Congress of Colombia recently passed an Internet copyright legislation, Ley 1520 of year 2012, also known as Ley Lleras 2.0, to implement the U.S.-Colombia Free Trade Agreement. With in the following weeks after Ley Lleras 2.0. was passed, a challenge was brought upon the law, and yesterday, because of a leak, the media announced, first, that the Colombian Constitutional Court had stuck down article 13 and 14, and later during the day, that the complete law went down. According to the information received, the law was declared unconstitutional on procedural and substantive grounds.

Although the Official Press Release of the Constitutional Court is not available yet and the ruling is expected to be published within the next days (weeks), this blogpost will do an approach of article 13 of Ley Lleras 2.0. which established the requirement for consent of the copyright holder for retransmission of TV signals online.?Whether the Court struck down or limited the scope of article 13, in the meantime we are releasing ?this paper with various legal arguments stating that article 13 goes beyond the Agreement?s (FTA) requirements, putting in place restrictions beyond what the Agreement require, beyond what related international treaties allow, and which are not matched by reciprocal U.S. law.

The main problems of article 13 of Ley Lleras 2.0. are as follows. First, the norm did not allow for any exceptions or limitations, and was not subject to three-step test which typically allows for countries to enact flexibilities to copyright law. Second, the article was not matched by reciprocal laws in the U.S., where the law governing the retransmission of broadcast signals is in flux, and where the relevant statutes do not expressly bar online systems from acting as ?multichannel video programming distributors? (e.g., cable and direct broadcast satellite television). Finally, the Act did not contain the flexibilities that are required for copyright laws to comport with freedom of expression, which raises problems both under Colombian and international law.

A. Exceptions and limitations.

Article 13 of Ley Lleras 2.0. does not reflect the evaluation of legislators over the need and desirability for society to use a work in comparison with the economic interests of copyright holders. This weighting process often leads to results that vary from country to country to determine which limitations are established in each national legislation and the form taken by each limitation. Indeed, some countries have adopted very restrictive limitations for copyright, such as France, Luxembourg and India, while others, like the United Kingdom, Australia and Canada, have included extensive provisions in their laws, which allow some acts that involve the use of the work without the prior permission of the copyright holder [1]. Whether restrictive or extensive, it is well known that Colombian legislation has also followed a weighting process, how ever, article 13 of Ley Lleras 2.0., with no reason excludes any possible balance between the rights involved.

Colombian copyright legislation contain, contrary to article 13, a regime where, under certain circumstances, the use of a copyrighted work by a third party does not require the permission/consent of the author/copyright holder, and sometimes, does not even?require?any payment of remuneration or compensation (quotation). We may find in Colombia, among others norms, articles 3, 22 and 32 of the Agreement 351 of the Andean Community and Articles 31 to 35, 37 to 41, 44 and 45 of Law 23 of 1982 of Colombia, norms were exceptions and limitations and the three-step-test is stablished. Contrary to the Colombian practice, Article 13 of Law Lleras does not include this criterion, nor allow any exception for the use of the copyright contents excluding the right to use content for educational, cultural or journalistic purposes.

The named norm also ignores the three step test to establish any exceptions or limitations which could lead to a breach of the Berne Convention. Many international copyright agreements incorporate a version of the ?three-step test,? under which signatory nations may adopt certain limitations or exceptions to copyright law. However, under international law certain limitations and exceptions to copyright law are mandatory. For example, Article 10 of the Berne Convention requires that countries allow for ?Certain Free Uses of Works.?[2] Colombia, being signatory of the Berne Convention should follow this norms, nevertheless, Article 13 of Ley Lleras 2.0. does not allow for these or any other uses, situation which could lead to a breach of the obligations established in Berne Agreement.

B. Asymmetry with US Laws

Article 13 of the Lleras Act 2.0. shows asymmetry with the current internal law of the United States on the retransmission of TV signals. Although Lleras Act 2.0. requires the copyright holder consent for the retransmission of the signal, the US law has a compulsory copyright license for the carriage of the TV signals for the Multichannel Video Programs Distributors (MVPDs), and the Communications Act of 1992 does not expressly exclude or prohibits the retransmission of signals by Online Video Distributors (OVDs).

In contrast to the provisions of Article 13, U.S. law does not expressly require the consent of a copyright owner to retransmit broadcast signals online. In the first place, all copyrights in the United States, for all uses, are subject to fair use. Retransmissions that constitute fair use are therefore allowed without the permission of copyright owners. Article 13 is clear enough to establish the prohibition, without exceptions, to retransmit without the consent of the copyright holder. While it is unclear exactly how this consent would be given, it is important to consider that the breach of this requirement would lead to civil or criminal consequences? (see article 16 of Ley Lleras 2.0).

Contrary to the US law, Ley Lleras in article 13 does not grant a compulsory copyright license regime. In the US law, the 1976 Copyright Act creates the compulsory license regime.? The 1992 Cable Act created the retransmission consent regime, which states that MVPDs need to get the permission of broadcasters (not the copyright holders in the programming) to retransmit their programming. ?The 1976 Copyright Act conditions the compulsory license on an MVPD following applicable FCC rules, however. ? Thus, an MVPD that fails to get the permission of a broadcaster to retransmit a signal, loses the compulsory license, and thereby becomes a copyright infringer.

It is important to consider that, concerning the Online systems, U.S. law is ambiguous as to whether they can qualify as ?cable systems? for either communications law or copyright purposes. The Federal Communications Commission (FCC) in Washington is currently considering whether an online service can qualify as a multichannel video programming distributor for the purposes of obtaining equal access to some kinds of programming, and the Second Circuit Court of Appeals in New York recently held that the controlling statutes are ?ambiguous? as to whether an online system can qualify as a cable system for the purpose of the cable copyright compulsory license[3].

C. Conflicts with International Law

Colombia Lleras Act 2.0. shows asymmetry with international human rights treaties, and ignores the domestic and international legal practices which generally search for a balance between copyright holders and the free flow of information and dissemination of knowledge.

The right to freedom of expression must be reconciled with copyright. Often, specific exceptions to copyright must be established to ensure that intellectual property rights do not trump this important human right. However, Lleras Law 2.0. provides no exception and therefore denies the right of freedom of expression enshrined in international standards. In most Western jurisdictions, freedom of expression extends not only to speech and the press, but also to the many areas in which individuals or groups may feel the need to express themselves: in politics, research, assemblies, art and culture, among others. The right of expression works then as a mechanism to limit and create exceptions to the monopoly on information in copyrighted works. Freedom of expression is enshrined as a fundamental right in the Universal Declaration of Human Rights and subsequently incorporated, among other treaties, in Article 19 of the International Covenant on Civil and Political Rights -ICCPR- and Article 13 of the American Convention on Human Rights ? ACHR-. However, the right to freedom of expression is diminished when Lleras Act 2.0. fails to? allow for any exceptions to a portion of the copyright regime.

Lleras Act 2.0. Colombia might be in breach of the Pacta Sunt Servanda principle of the Vienna Convention for violation of the right of freedom of expression included in two human rights treaties ratified by Colombia: the ACHR and the ICCPR. This principle, as well for the Vienna Treaty, has been ratified by Colombia and, according to the Constitutional Court, the authorities are obliged to ensure the observance of ratified treaties (Constitutional Court C-400/98, C-155/00, C-750/08). Article 13 the of the ACHR ? American Convention on Human Rights was included as article 20? in the Colombian Constitution,? and article 19 of the International Convenant on Civil Rights was included as article 29 of the Colombian Constitution. However, Lleras Act 2.0., by providing for no exceptions or limitations on a copyright requirement, denies the right of freedom of expression, situation that could lead to a breach of the ACHR and the ICCPR accordingly to the Vienna Convention.

Lleras Act 2.0. Colombia might be also in asymmetry with the internal US Statue and with previuos rulings of US Courts.? As the U.S. Supreme Court has held, copyright laws would violate the First Amendment to the U.S. Constitution (which guarantees freedom of expression) unless they have ?built-in First Amendment accommodations,? such as the idea/expression dichotomy and fair use. The Copyright Term Extension Act (CTEA) of 1998 of the US, itself supplements the traditional First Amendment? safeguards in two ways, contrary to what Lleras Act 2.0. does. ? See Eldred v. Ashcroft 537 U.S. 186 (2003) 239 F.3d 372. The first allows libraries and similar institutions to reproduce and distribute copies of certain published works for scholarly purposes during the last 20 years of any copyright term, if the work is not already being exploited commercially and further copies are unavailable at a reasonable price, ?108(h); the second exempts small businesses from having to pay performance royalties on music played from licensed radio, television, and similar facilities, ?110(5)(B).? How ever Lleras Act 2.0. does not include any possible uses in a assymetry to the internal laws of the US.

Conclusions

The internet copyright legislation ? Lleras Act 2.0.- passed by the Congress of Colombia to implement the last year approved FTA with the U.S., goes beyond the Agreement generating asymmetry with internal Colombia Law, U.S. domestic law and related international treaties. First, the norm does not allow any exceptions or limitations, nor the three step test to the copyright requirement; second, in the U.S. the law governing the retransmission of broadcast signals is in flux, and where the relevant statutes do not expressly bar online systems from acting as ?multichannel video programming distributors?; and third, the Lleras Act 2.0. shows asymmetry with international human rights treaties in violation of the right of freedom of expression.

While it is undisputed that the basic framework of rules for copyright and related rights are generally applicable to the digital networked environment, the precise scope and limitations of these rights is a major outstanding problem facing legislators. Confronted with difficult legal and policy problems, and facing pressure from the U.S. government, and from foreign and domestic content and media industries to hastily enact new legislation, it is unfortunate but not surprising that some national legislatures have enacted laws that are not fully considered. Lleras Act 2.0 is an example of such a law. Its very structure shows its carelessness: It simply directly incorporates the language of the Agreement, even wording that is illogical in the context of a domestic law.

By failing to incorporate limitations or exceptions, the Ley Lleras 2.0. is not consistent with the norms that have been in place since the Berne Convention. And while facially an attempt to protect the rights of content creators online, the law could instead be a tool by which established video distributors lock in their market positions and outlaw potential competition by new services. By limiting the future development of online video distribution in Colombia, the Act fails to promote the interests of Colombian consumers. It is not necessary to implement the Agreement in a way that has these bad consequences.

The Charleston Police Department has arrested the former Charleston Animal Society president who is accused of spitting soup multiple times on a car?belonging to a former board member. ?

Investigators arrested?56-year-old Charles Karesh on Thursday and?charged him?with malicious injury to a person.

On Dec. 27, police met with the victim at a home on Cumberland Street regarding vandalism to his car.? The victim said on Christmas Eve and on several other occasions, someone spit what appeared to be soup on the trunk of his car which caused minor damage to the paint of the vehicle.

According to investigators, the victim hired a private investigator who videotaped Karesh vandalizing the victim's vehicle on at least one occasion.

Karesh stepped down from the Charleston Animal Society in 2011?after a criminal investigation uncovered $69,000 was taken from the organization.

The victim said he believed that Karesh may be holding a grudge against him for that case.

(AP) ? The first of six Patriot missile batteries being deployed to Turkey to protect against attack from Syria was declared operational and placed under NATO command, the international organization said Saturday.

The battery, provided by the Netherlands, is meant to protect the city of Adana by shooting down missiles that could come over the Syrian border. Turkey has become a harsh critic of the regime in Syria, where a vicious civil war has left at least 60,000 people dead.

The United States, Germany and the Netherlands are providing two batteries each of the latest version of the U.S.-made Patriots. The other five Patriot batteries are expected to be in place and operational in the coming days in Adana, Kahramanmaras and Gaziantep.

"This is a clear demonstration of the agility and flexibility of NATO forces and of our willingness to defend Allies who face threats in an unstable world," Admiral James Stavridis, NATO's Supreme Allied Commander for Europe, said in a statement.

NATO reiterated Saturday that the Patriots are for defensive purposes only. Syria has not fired any of its surface-to-surface missiles at Turkey during its nearly two-year civil war and its government has described the NATO deployment as a provocation.

NATO also deployed Patriot batteries to Turkey during the U.S.-led invasion of Iraq 10 years ago. They were never used and were withdrawn a few months later.

Have you ever come across that relationship status on Facebook, ?It?s complicated? and thought to yourself, ?What does that really mean?? I know I have, I know most of us have. Most times, we think it?s a joke and we ignore it. A few times, we?ve actually known the situation that our friends were talking about and we knew that in fact, the situation was complicated. That?s Facebook, but what about in real life? That?s probably a more frequent term to hear, wouldn?t you agree? There?s a guy friend of yours who?s trying to explain how complicated his situation is soooo complicated rather than just admit, it ain?t really working out. (Can?t lie, I?ve been there before.) Or, there?s a girlfriend of yours who?s trying to explain how her situation with Eric is just soooo complicated. She explains over?margaritas?and in one conversation she says, ?Oh my God, you don?t understand?? about 20 times.

I think we?ve all been there before. How do we find the ways to tell our friends that their relationship isn?t all that complicated? Does ?It?s Complicated? really exist? Moreover, what does it really mean to be in a situation that is complicated? I came across this article and thought that I hadn?t read something more accurate with describing ?complicated? relationships. In short, this article seeks to show us that if you think your relationship is complicated, it?s really not. If you describe your relationship as complicated, it?s indicative that maybe it?s not much of a relationship at all. All of us who have been in love or have been in healthy relationships have never had to say, ?it?s complicated.? Either you are in a relationship, or you are not. It?s very simple.

I know, we?ve all been in or heard about the high drama?relationships?of so-called love where there?s all the angst, passion, high strung emotions and everything else that makes it fell like the real thing, but the reality is that those kind of relationships, while they may be exciting at first, quickly begin to feel like anything but love. I know. I?ve been there too. The bottom line is, anytime you?ve got that much going on in a relationship, it?s not love. Because love?is just not that.?Real love?is simple.

Former NFL football player Erxleben arrested in Ponzi scheme

SAN ANTONIO (Reuters) - Former college All-American and National Football League kicker Russell Erxleben was arrested by federal agents on Thursday at his home near Austin, Texas on federal fraud charges.

Erxleben, 56, was charged in a federal indictment unsealed on Thursday with five counts of wire fraud, one count of securities fraud and two counts of money laundering.

In 1999, he was convicted of securities fraud and conspiracy to commit securities fraud, and was sentenced to 84 months in prison.

This time, Erxleben was charged with setting up several companies and soliciting investors in a scheme to buy post-World War One German government gold bearer bonds and a painting by French artist Paul Gauguin.

Instead, Erxleben used investor money for himself and to pay dividends to previous investors, a classic Ponzi scheme, said Darrell Fields, a spokesman for the U.S. Attorney for the Western District of Texas.

"Erxleben made various wire transfers using numerous financial accounts which were opened and maintained by others, including family members, in an effort to avoid detection," Fields said.

The scheme generated more than $2 million, Fields said. Erxleben still owes $28 million in restitution from his previous fraud conviction, Fields said.

Erxleben is also charged with failing to disclose to his new investors his role in the 1999 conviction.

Erxleben was an All-American kicker for the University of Texas in the 1970s, where he kicked the longest field goal in college football history, 67 yards. He was drafted in the first round in 1977 by the New Orleans Saints, where he played for six seasons.

Erxleben will remain in federal custody pending a detention hearing set for next week, Fields said.

Caloric restriction has a protective effect on chromosomes

Jan. 23, 2013 ? One of the indicators of a cell's health is the state of its DNA and containers -- the chromosomes -- so when these fuse together or suffer anomalies, they can become the source of illnesses like cancer and/or aging processes.

According to a study carried out by a team led by Mar?a Blasco, the director of the Spanish National Cancer Research Centre (CNIO) and head of the Telomeres and Telomerase Group, a sustained lowering of food intake over time results in an increase of telomere length -- the ends of chromosomes -- in adult mice, which has a protective effect on the DNA and genetic material.

These beneficial effects on the youth of the chromosomes translate to a lower incidence of cancer and other age-related illnesses. The journal PLOS ONE is to publish the details of this study in its online edition this week.

A lower incidence of cancer and better health

To carry out the study, researchers used young mice -- just three months old -- and reduced their caloric intake by 40% before observing them until the end of their life cycle.

"We see that mice that undergo caloric restriction show a lower telomere shortening rate than those fed with a normal diet," says Blasco. "These mice therefore have longer telomeres as adults, as well as lower rates of chromosome anomalies," she adds.

To study the effects of this phenomenon on the health of the mammals, researchers observed the incidence of age-related illnesses like cancer. The mice that had been fed a lower calorie intake showed a reduction in the incidence of cancer. Furthermore, these mice also showed a lower incidence of other age-related illnesses such as osteoporosis, greater glucose uptake or improvements in motor coordination.

When the researchers carried out these same experiments with a variety of mice that produce more telomerase -- a protein that lengthens telomeres and protects chromosomes -- they observed that these mice not only enjoyed better health but also lived up to 20% longer.

"We believe that such a significant increase in longevity is due to the protective effect against cancer produced by caloric restriction -- incidents fall by 40% if we compare them with the mice that produce more telomerase and have a normal diet -- and, added to the presence of longer telomeres, this makes the mice live longer and better," says Blasco.

Despite the effects of caloric restriction depending on the genetic characteristics of each organism, this study opens the way to studying the effect other factors and lifestyle habits, such as smoking or exercise, might have on aging.

Furthermore, it is calculated that there are currently more than 10,000 people in the world on some form of controlled caloric restriction, so the observation of these individuals will be decisive in discovering the effects of this type of diet on humans.
